WHAT ARE “UNBUNDLED” LEGAL SERVICES?
The term refers to situations in which a client hires an attorney to assist with specific elements of a matter such as legal advice, document preparation, document review and/or limited court appearances. The client and attorney agree on the specific tasks to be performed by the attorney and the client hires the attorney to perform only those specific tasks. The attorney may or may not enter an appearance with the court. The client represents him/herself in other aspects of the case.
IS UNBUNDLING RIGHT FOR ME?
There are some clients who are comfortable with preparing the paperwork on their own, but they do not want to represent themselves in court. In those cases the client would prepare the paperwork and then we would meet so that I can review the documents, discuss the goals and objectives of the client and prepare for the court appearance. At the time of the hearing, I would file a form called Limited Scope Representation and appear for that one hearing.
There are other cases where a client is able to appear for themselves at the court, but they want to have an attorney assist them in the preparation of the documents for court. I “ghost write” the motions, court forms and declarations for the client. Those documents are then filed with the court with the client representing themselves “in pro per.”
Unbundling is not right for everyone. In some cases, it is more effective to retain an attorney to handle all aspects of the case.
WHAT IS THE ADVANTAGE OF UNBUNDLING?
Unbundling offers the self-represented client an affordable option to qualified legal representation. For a client who is comfortable in representing themselves, but want assistance in certain areas, unbundling can be a cost effective option. There are many document centers which offer paralegal assistance, however these centers do not offer a client any legal remedy if the documents are not prepared correctly.
