Family Law Consulting is the process by which a party uses the skills and legal guidance of an attorney however the attorney does not represent them and does not become the attorney of record in the Divorce Case.

Family Law Consulting is the process by which a party uses the skills and legal guidance of an attorney however the attorney does not represent them and does not become the attorney of record in the Divorce Case. Many times parties will resolve matters through mediation however they want their own representation so that they may be advised of their rights and interests in the legal process.  They will want to use the services of an attorney to consult with them prior to the meetings with the mediator.

In other cases a party may be comfortable with preparing their court documents and representing them in their Legal matter however they wish to have someone advise them of how they should present evidence in the hearing, what orders that they wish to have made and to provide with guidance on the forms that they have completed.

Divorce Consulting

Parties may wish to have an attorney available during their Divorce to provide them with guidance on how to Navigate through the Divorce process. This works in cases where the parties are amicable and they are working together to come to agreements either on their own or through an independent mediator.

The party may wish to have their own attorney review the financial disclosures and advise them of the potential outcomes for matters such as the division of property, spousal support and child support calculations and whether or not they should agree to waive support or they should purchase their spouse out of the house.

In a consulting matter the attorney would not be preparing any documents for the client, however they will advise them of the issues that should be discussed and addressed in mediation and they will review any proposed orders prior to the client signing a Final Judgment of Dissolution. If there are points of contention, the attorney may provide guidance on what some solutions could be so that the client is prepared for the mediation.

In a litigation matter, the attorney would review documents that are prepared by the client and advise them of any evidence which should be presented in order to support their position. The consulting attorney may also assist them to prepare their arguments in court.

Child Custody Consulting

As child custody can be a heavily litigated issue, there are times where a client is unable to afford a Full Scope attorney to represent them in all aspects of the child custody matter.  In other cases, the parties wish to avoid court and to come to an agreement on child custody outside of court.  Consulting with an attorney can be extremely valuable in these matters.  We assist our clients with parenting plan options and present detailed items that can be included in a parenting plan to insure that there are no issues in the future. We will work with our clients on proposed holiday schedules, ways to communicate with the other parent and how to handle issues relating to school or extracurricular activities for the child. The client may then discuss these issues in mediation either at the Court or with a private mediator and may use the proposed parenting plan in their arguments with the court.
